The Madras High Court examined the administrative division of taxpayers between Central and State GST authorities and held that, in the absence of a notification providing for cross-empowerment, the counterpart administration cannot initiate proceedings against a taxpayer assigned to the other authority. The statutory framework on cross-empowerment operates as a safeguard against parallel and overlapping action, and proceedings initiated by the wrong administration are without jurisdiction. The ruling is widely cited in jurisdictional challenges.
What to do about it: Check which administration your GSTIN is assigned to — a notice from the other wing can be challenged on jurisdiction, though verify the current appellate status before relying solely on this ground.
32nd GST Council Meeting, New Delhi — 10 January 2019 · 2019-01-10
The Council created two threshold limits for exemption from registration and payment of GST for suppliers of goods, Rs 40 lakh and Rs 20 lakh, and gave states a week to choose which limit would apply in their territory. The threshold for service providers was left unchanged at Rs 20 lakh, and at Rs 10 lakh for special category states. The change was made operational from 1 April 2019 and remains the basic registration test for traders and manufacturers today.

Circular No. 132/2/2020-GST dated 18 March 2020 · 2020-03-18
Several appellate authorities were refusing to decide appeals on the ground that the GST Appellate Tribunal did not exist. CBIC clarified that this is not a valid reason to defer disposal, and that under the Removal of Difficulty Order the three-month period for filing an appeal to the Tribunal starts only from the date on which the President of the Tribunal enters office. Appellate authorities were directed to record this position in their orders so that appellants are not prejudiced.
Why this matters: A Chennai taxpayer who loses at first appeal does not lose the right to go to the Tribunal, because limitation only begins once the Tribunal is functional.
