What to do about it: If you have received an interest demand computed on gross output tax for a late return, the net cash liability principle from this meeting is usually a complete answer.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What to do about it: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Only Rs 500 penalty for minor e-way bill errors, not detention under section 129

CBIC listed six situations that must not attract detention proceedings where both an invoice and an e-way bill accompany the goods: a spelling mistake in the consignor or consignee name where the GSTIN is correct, a wrong PIN code where the address is correct, an error in one or two digits of the document number, an error in the fourth or sixth digit of the HSN where the rate is right, and an error in the vehicle number. Penalty is only Rs 500 each under CGST and SGST in FORM GST DRC-07.

I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Puzhal as urgent.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?

My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. For most small businesses a corrected fresh application is faster than an appeal. ChennaiGST reviews the rejection reasons first and then recommends the quicker route for your case.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. I received an ASMT-10 scrutiny notice for my Puzhal business. What exactly is it?
ASMT-10 is a notice issued under Section 61 after the officer scrutinises your filed returns and finds discrepancies, such as differences between GSTR-1 and GSTR-3B, excess ITC compared with GSTR-2B, or turnover gaps against e-way bill data. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital.
