GSTN Advisory dated 31 August 2023 — Electronic Credit Reversal and Re-claimed Statement · 2023-08-31
GSTN introduced the Electronic Credit Reversal and Re-claimed Statement on the portal to track credit reversed in Table 4B(2) of GSTR-3B and later reclaimed in Tables 4D(1) and 4A(5). It applied from the August 2023 return for monthly filers and from the July to September 2023 quarter for quarterly filers. The cumulative opening balance of reversals awaiting reclaim had to be reported by 30 November 2023, with up to three amendments allowed until 31 December 2023. The portal now warns when reclaimed credit exceeds the available balance.
What to do about it: Maintain a running register of credit reversed and reclaimed, because the portal flags excess reclaims and the data feeds departmental scrutiny.
Circular No. 167/23/2021-GST dated 17 December 2021 · 2021-12-17
Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.
What to do about it: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.
Premier Sales Promotion (P) Ltd v. Union of India — Karnataka High Court, 2023 · 2023-01-16
A company procuring and supplying prepaid vouchers, gift cards and e-vouchers to corporate clients was held liable to GST by the AAR and AAAR. The Karnataka High Court reversed, holding that vouchers are in the nature of pre-deposit instruments or actionable claims — a means of payment for future supplies — and their mere trading is neither a supply of goods nor of services, so no GST is payable on the voucher itself. CBIC later clarified voucher taxation consistently with this position.
Practical effect: Businesses running gift card and reward programmes should tax the underlying redemption supply, not the voucher transaction, and review past assessments in light of this ruling.
