This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Practical effect: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Healthcare services by clinical establishments are exempt

Entry 74, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

Entry 74 exempts health care services provided by a clinical establishment, an authorised medical practitioner or paramedics, and the transportation of a patient in an ambulance. Health care services are defined as diagnosis, treatment or care for illness, injury, deformity, abnormality or pregnancy in any recognised system of medicine, and expressly exclude cosmetic or plastic surgery unless done to restore or reconstruct anatomy affected by injury or congenital defect. Hair transplant and purely cosmetic procedures are therefore taxable.

There is no outer time limit on issuing a debit note itself. Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Classifying civil costs correctly during a project saves disputes at audit.
How should I raise invoices on foreign clients and report them in my returns?
You may invoice in foreign currency, but your GST records must state the value in rupees. An export invoice under LUT should carry the endorsement that the supply is meant for export under Letter of Undertaking without payment of integrated tax, along with your GSTIN, SAC code and the recipient's overseas address. In GSTR-1, these invoices go into Table 6A marked without payment of tax, and the turnover flows into GSTR-3B as zero-rated supplies. Match every invoice to a FIRC or bank credit. Do I have to pay GST on my Adobe, Canva or AWS subscriptions billed from abroad?
If you are GST-registered and the foreign supplier has not charged Indian GST, yes. Services received from a supplier located outside India for business purposes are an import of services, taxable in your hands under reverse charge at 18 percent. You must pay the tax in cash through GSTR-3B, raise a self-invoice, and can simultaneously claim the same amount as input tax credit if the expense is otherwise eligible, making it cash-flow neutral for most businesses. Unregistered persons do not pay reverse charge; instead, the foreign provider may charge GST under the OIDAR rules. Many Puzhuthivakkam agencies miss these entries during scrutiny.

From this common pool, you reverse the portion equal to exempt turnover divided by total turnover for the month, plus a flat five percent of the common credit where inputs are partly used for non-business purposes. The reversal is declared monthly in GSTR-3B, and a final recomputation for the whole year must be done, with any shortfall paid with interest, by the November return following the financial year.
