The Supreme Court held that the transaction value declared by an importer must ordinarily be accepted. Before rejecting it, the proper officer must have a reasonable doubt based on certain material and specific reasons, must communicate those grounds to the importer, and must give an opportunity to explain. A mere suspicion, or reliance on price data without disclosure, is not sufficient to displace the declared value.

Faced with widespread filing difficulties, the Council approved a revised schedule for the first tax period: GSTR-1 for July 2017 to 10 October (3 October for taxpayers above Rs 100 crore turnover), GSTR-2 to 31 October, GSTR-3 to 10 November and GSTR-6 to 13 October. Table 4 of GSTR-4 was not to be filled for the July-September quarter and GSTR-4A was dispensed with. GSTR-3B was to continue for August to December 2017.
What it means for you: The invoice-matching return cycle of GSTR-1, 2 and 3 collapsed almost immediately, and GSTR-3B became the permanent monthly filing every Chennai business now does.

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.
Why this matters: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.
