A Division Bench of the Madras High Court upheld the validity of Section 54(3)(ii) CGST Act and Rule 89(5), holding that Parliament consciously restricted refund of unutilised ITC under the inverted duty structure to credit accumulated on input goods, and that excluding input services from the refund formula is neither ultra vires nor unconstitutional. This view, which conflicted with the Gujarat High Court's VKC Footsteps ruling, was later affirmed by the Supreme Court.
Why this matters: Inverted duty refund computations for Tamil Nadu businesses must exclude input service credits — structure contracts and procurement with this settled limitation in mind.

GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.
Practical effect: Keep returns current and your export invoice register clean, since refunds are now claimed invoice by invoice and each invoice can be used only once.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
What it means for you: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.
