Lockdown limitation relief extended from 30 June to 31 August 2020

Notification No. 55/2020-Central Tax · 2020-06-27

This notification amended the earlier Section 168A notification and moved the outer date for compliances falling due between 20 March 2020 and 30 August 2020 to 31 August 2020. In substance it gave a further two months to complete any action, order, notice, appeal or application whose limitation had been frozen since the start of the lockdown. Officers as well as taxpayers took the benefit, so departmental orders passed up to that date remain valid.

What to do about it: When computing whether an appeal or an assessment for 2020 is within time, the period up to 31 August 2020 must be excluded under this notification.

Rich Dairy Products (India) Pvt Ltd - AAR Tamil Nadu (2019), upheld by AAAR Tamil Nadu, Order No. TN/AAAR/01/2020 · 2019

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Practical effect: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. Without this mapping, recovery notices can continue despite full payment, so businesses in Saidapet with paid-but-open demands should file DRC-03A promptly.
How do I reply to a DRC-01 show cause notice online?

You do, as the recipient.
