The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.

The Supreme Court held that once credit has been validly taken on inputs, it becomes indefeasible. There is no correlation required between a particular input and a particular final product, and the credit need not be reversed merely because the inputs are later used differently, unless a specific provision so requires. Credit is available for utilisation at any time until it is actually used to discharge duty.
Why this matters: A Chennai business can resist reversal demands where the credit was validly taken and no specific provision of the GST law requires reversal.

CBIC clarified that under Rule 88B(3), interest under Section 50(3) arises only where wrongly availed input tax credit has actually been utilised. Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.
