During a search and investigation the officers pressed the taxpayer to reverse credit and pay tax before any notice was issued. The High Court held that Section 74(5) merely gives the taxpayer an option to pay voluntarily; it does not empower officers to demand or coerce payment before a show cause notice. Raising a demand while the investigation is incomplete was held to be arbitrary and without jurisdiction, and refund of the amounts collected was directed.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?

What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. How do I get a provisional attachment on my property or bank account lifted quickly?

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. Largely, yes. Most notices arise from mismatches the portal detects automatically: GSTR-1 versus GSTR-3B tax differences, ITC claimed beyond GSTR-2B, e-way bill turnover gaps and unfiled returns. A periodic review catches these before the system does, so you can correct them through amendments in subsequent returns or a voluntary DRC-03 payment with interest, which under Section 73 attracts no penalty and no notice for the amount paid. What a review cannot prevent are genuine interpretation disputes, but even there it prepares your documentation in advance. I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?

How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
How is GST charged on hotel room tariffs after the rate changes?
Hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, a reduction from the earlier 12 percent. Rooms priced above Rs.7,500 per day attract 18 percent with full input tax credit. The rate is determined by the actual transaction value charged for the room, so seasonal discounts can change the applicable rate on the same room across bookings. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC.
