Main Road is a residential street in Sembium, about 750 m north of the centre of Sembium. A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.
What to do about it: Chennai apartment associations should apply the High Court position carefully and keep member-wise workings ready for departmental scrutiny.
22nd GST Council Meeting, New Delhi — 6 October 2017 (PIB Release ID 1505133) · 2017-10-06
The Council raised the composition scheme threshold from Rs 75 lakh to Rs 1 crore of annual aggregate turnover, and from Rs 50 lakh to Rs 75 lakh for Special Category States other than Jammu and Kashmir and Uttarakhand, which were given Rs 1 crore. Both migrated and new taxpayers could opt in under the higher threshold up to 31 March 2018, with the option becoming operational from the first day of the month following the month in which it was exercised.
Practical effect: This brought a large part of Chennai's small trading and restaurant sector within reach of quarterly composition filing instead of monthly returns.
Circular No. 167/23/2021-GST dated 17 December 2021 · 2021-12-17
Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.
What to do about it: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.
