The twenty per cent cap on credit not appearing in GSTR-2A explained

Circular No. 123/42/2019-GST dated 11 November 2019 · 2019-11-11

CBIC explained the newly inserted rule 36(4). The restriction is not supplier-wise but is computed on a consolidated basis for all invoices not appearing in GSTR-2A. The amount of eligible credit is determined from GSTR-2A as on the due date for filing GSTR-1 by suppliers for that month. A taxpayer may therefore claim only twenty per cent more than the credit reflected in GSTR-2A, and the balance may be claimed in a later month once the supplier uploads the invoice.

What it means for you: This circular began the era of credit being tied to supplier filings, and monthly reconciliation of purchases with GSTR-2A or 2B is now unavoidable.

All electric vehicles cut to 5 per cent and chargers from 18 to 5 per cent

36th GST Council Meeting (video conferencing) — 27 July 2019 · 2019-07-27

The Council reduced GST on all electric vehicles from 12 per cent to 5 per cent and on chargers or charging stations for electric vehicles from 18 per cent to 5 per cent. Hiring of electric buses with carrying capacity of more than twelve passengers by local authorities was exempted. All these changes took effect from 1 August 2019. The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.

What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
Our Sembium factory hires lorries through a transport agency. Who pays the GST?
Under the reverse charge entry, when a GTA that has not opted for forward charge provides service to specified recipients, the recipient pays the 5 percent tax. Specified recipients include factories, registered persons, body corporates, partnership firms including AOPs, co-operative societies and casual taxable persons. Your factory therefore pays 5 percent in cash through GSTR-3B, reports it in the reverse charge tables, and claims the same amount as input tax credit since freight is a business expense. Confirm from the transporter's invoice or declaration whether it has opted for forward charge, because paying RCM on an FCM invoice creates double taxation. Do I have to report HSN codes in my GSTR-1?
Yes. Taxpayers with aggregate turnover up to Rs.5 crore must report a 4-digit HSN summary for B2B supplies in Table 12 of GSTR-1, while those above Rs.5 crore must report 6-digit HSN codes for all supplies. The portal now validates HSN entries against its master list, so wrong or truncated codes can block filing. My SaaS startup in Sembium bills both US and Indian customers. Is everything zero-rated?
No. Only the supplies satisfying the export conditions are zero-rated under your LUT. Subscriptions billed to customers located in India are ordinary taxable supplies at 18 percent, with the place of supply being the registered customer's location, or the address on record for unregistered users. Your GSTR-1 must therefore separate export invoices from domestic B2B and B2C supplies, and your accumulated ITC refund is computed only in proportion to export turnover. My workshop bills customers for spare parts and labour together. How should GST be charged?
The accepted practice, supported by CBIC's clarification on servicing, is that where the invoice separately shows the value of parts and the value of labour, each takes its own treatment: parts as a supply of goods and repair labour as a service at 18%. Since auto components also moved to 18% from September 2025, both lines of a typical job card now carry the same rate, which removes the old temptation to shift value between parts and labour. I received a debit note from a supplier for an old invoice. Which year's ITC deadline applies?
The deadline is counted from the date of the debit note, not the original invoice. After the Finance Act 2020 delinked debit notes from their underlying invoices, ITC on a debit note can be claimed up to 30 November following the end of the financial year in which the debit note itself was issued. So a debit note dated June 2025 against an invoice of January 2024 remains claimable until 30 November 2026. This delinking rescues many price-escalation and rate-difference credits that would otherwise appear time-barred, and it is worth checking before writing off any debit note credit as lost.
I am under QRMP in Chennai. When is my quarterly GSTR-3B due?
For taxpayers registered in Tamil Nadu, which falls in the category of states with the earlier date, the quarterly GSTR-3B under QRMP is due on the 22nd of the month following the quarter. So the return for April to June is due by 22 July, and so on for each quarter. The quarterly GSTR-1 is due by the 13th of the same month. How do I claim credit of the IGST paid on imported goods?
IGST paid at customs on imported goods is fully creditable, with the bill of entry serving as the prescribed duty-paying document instead of a tax invoice. The data flows from ICEGATE into your GSTR-2B, and the claim is made in Table 4(A)(1) of GSTR-3B. If a bill of entry does not appear, use the search BoE facility on the GST portal to fetch the record before assuming it is missing. Remember that basic customs duty and the social welfare surcharge are never creditable; only the IGST and compensation cess components are. Importers in Sembium should reconcile their ICEGATE ledger with GSTR-2B quarterly, because clearance-date mismatches are frequent.
What are the GST rates on gold, silver and diamond jewellery?
The special rates on precious metals were retained in the GST 2.0 restructuring. Gold, silver and articles of jewellery attract 3 percent GST, rough and unworked diamonds attract 0.25 percent, and jewellery making charges billed separately attract 5 percent. When a jeweller bills a customer, the metal value and making charges can appear as separate line items with their respective rates on the same tax invoice. Old gold purchased from an unregistered customer in exchange transactions does not attract GST in the customer's hands, but valuation of the net supply must be documented carefully.
We sponsored a trade event. Does reverse charge apply to the sponsorship amount?
If your business is a body corporate or partnership firm, sponsorship services received are notified under Section 9(3) and you must pay 18 percent GST under reverse charge, with ITC available since sponsorship is a marketing expense. One recent change matters: with effect from 16 January 2025, sponsorship services provided by a body corporate were moved to forward charge, so if the event organiser billing you is a company, it now charges GST on its invoice and RCM does not apply. Where the provider is a proprietor, trust or society, RCM continues. Verify the organiser's constitution before booking the entry, and raise a self-invoice where the provider is unregistered.
When can goods move on a delivery challan instead of a tax invoice?
Rule 55 permits movement on a delivery challan where the transportation is not itself a supply: sending inputs or capital goods for job work, taking goods to an exhibition or for approval where the sale is not yet certain, supplying liquid gas where the quantity is unknown at removal, and moving goods in semi-knocked-down form in multiple consignments, where the full invoice travels with the first lot. The challan is prepared in triplicate and an e-way bill is still required where value thresholds are crossed. Goods sent on approval must be invoiced within six months, failing which tax becomes payable.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. What GST do hotels charge on room tariffs after the 2025 rate changes?
From 22 September 2025, hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, and accommodation above Rs.7,500 attracts 18 percent with input tax credit. The earlier 12 percent slab for mid-range rooms was abolished in the rate rationalisation. Tax applies on the actual transaction value charged, so a discounted rate below Rs.7,500 falls in the 5 percent bracket even if the printed tariff is higher. Hotels should reconfigure billing software slab-wise and watch the ITC restriction on the 5 percent category, which changes costing materially.
What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Nearly all goods that were at 12 percent moved down to 5 percent, and the bulk of the 28 percent items moved to 18 percent, with only a small set of luxury and demerit goods shifted up to the special 40 percent rate. This means old rate charts, printed price lists and software masters created before September 2025 are unreliable.
