The Council completed the fitment exercise for goods and broadly approved GST rates at nil, five, twelve, eighteen and twenty-eight per cent across the tariff, along with the rates of GST compensation cess to be levied on specified goods. A best-of-judgment assessment of about Rs 5 lakh was raised for non-filing of the April 2023 return, the dealer contending that the real liability was about Rs 2 lakh, which was paid once the assessment came to its notice. The Madras High Court permitted the dealer to file an application for condonation of the delay in filing the return and directed the State Tax Officer to consider that application sympathetically in the light of the Court's earlier precedent. The writ petition was disposed of on those terms without any order as to costs.
Practical effect: Where late returns have triggered adverse consequences, a formal condonation application supported by reasons is the correct first step in Tamil Nadu.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
Practical effect: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.
