The customer supplying only the content or artwork did not alter the classification.

Wipro Ltd India v. Assistant Commissioner of Central Taxes — Karnataka High Court, Writ Petition No. 16175 of 2022, judgment dated 6 January 2023 · 2023-01-06

Invoices had been raised showing the GSTIN of a group company instead of the actual recipient, which prevented the recipient from claiming credit. The High Court held the mistake was bona fide and inadvertent, applied Circular No. 183/15/2022-GST, and directed the authorities to permit rectification of the invoices and the corresponding returns for 2017-18 and 2018-19, and extended the same benefit to 2019-20 taking a justice-oriented approach.

Practical effect: A wrong GSTIN or similar clerical error in old invoices is not necessarily fatal — a rectification request supported by this judgment and Circular 183 is worth pursuing.

How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
What information is needed to prepare my GSTR-9?
The portal auto-drafts GSTR-9 from your filed GSTR-1 and GSTR-3B, and provides a system-computed summary along with GSTR-2A/2B data for credit tables. To verify and complete it we need your audited or finalised financial statements, sales and purchase registers, input tax credit ledger, details of RCM payments, HSN-wise summaries, and any DRC-03 payments made during the year. Differences between books and returns must be explained and, where needed, paid. Sharing these by early November gives enough time for a clean filing before 31 December. Is there a late fee if I delay the monthly PMT-06 payment under QRMP?
No late fee applies to a delayed PMT-06 deposit, because late fee is linked only to returns. However, interest at 18 percent per annum is payable on the shortfall for the delay period. Note that if you used the fixed sum method and paid the pre-filled 35 percent amount on time, no interest applies for the first two months even if actual liability was higher, provided the balance is paid in the quarterly GSTR-3B by its due date. Late fee does apply if the quarterly GSTR-1 or GSTR-3B itself is filed late.
Is there a last date to claim input tax credit for a financial year?
Yes. Under Section 16(4), ITC for invoices and debit notes of a financial year must be claimed by the earlier of 30 November following the end of that financial year or the date of filing the annual return GSTR-9. So credit on a March 2026 invoice must be taken in a GSTR-3B filed on or before 30 November 2026. Credits discovered after this date are permanently lost, which is why a year-end reconciliation in September or October, comparing books, GSTR-2B and GSTR-3B for the full year, is essential for every business in Tambaram.
Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate.
