Saro Enterprises - AAR Tamil Nadu (2018), upheld by AAAR Tamil Nadu, order dated 6 February 2019 · 2018

The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

I paid my supplier only part of the invoice within 180 days. How much ITC do I reverse?
The reversal is proportionate. If you paid sixty percent of the invoice value including tax within 180 days, you reverse only the ITC attributable to the unpaid forty percent, reporting it in Table 4(B)(2) of the GSTR-3B for the tax period immediately following the expiry of the 180 days. Amounts settled through book adjustments, such as netting off mutual dues or debit notes for quality deductions reducing the payable, have been accepted as payment in advance rulings, so a properly documented ledger adjustment protects the credit. Retention money held under contract terms is the most common trigger we see in Tambaram construction and job-work businesses.
Is ITC available on food, catering and canteen expenses for our factory staff?
Section 17(5)(b) blocks credit on food, beverages and outdoor catering, but with two useful exceptions. First, where you use catering as an input for making an outward supply of the same category, such as a caterer subcontracting another caterer, credit is allowed. Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.

What is the difference between a GST credit note and a commercial credit note?
