GSTN Advisory, 2022 — Table 3.1.1 of Form GSTR-3B introduced by Notification No. 14/2022-Central Tax, dated 5 July 2022 · 2022

Table 3.1.1 was added to GSTR-3B so that supplies notified under Section 9(5), such as passenger transport, restaurant service supplied through an app, hotel accommodation and housekeeping, are reported separately. The e-commerce operator reports the value and pays the tax in row (i), while the underlying supplier reports the same value in row (ii) and pays nothing on it, so the turnover is not counted twice across the two returns.

What it means for you: Chennai restaurants and cab operators supplying through an app must still report those sales in Table 3.1.1(ii) even though the platform pays the tax.

The 55th GST Council recommended a single rate for the second-hand vehicle trade, and this notification raised the concessional rate on old and used motor vehicles, including electric vehicles, from twelve per cent to eighteen per cent. The tax continues to be charged only on the supplier's margin, and the levy still applies only where the seller is registered and is dealing in such vehicles; a sale by one individual to another remains outside GST altogether.

Why this matters: Used-car dealerships in Chennai charge eighteen per cent on the margin from 16 January 2025, while private person-to-person sales attract no GST.

When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. The credit note references the original invoice, and reporting it in your GSTR-1 reduces your output tax liability for that period. It is the correct tool for sales returns, rate errors and quality claims. What a credit note cannot do is cancel an e-invoice after the twenty-four hour IRP window or rewrite history for a different customer; it must trace to a genuine adjustment on an identified invoice.
What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
What information is needed to prepare my GSTR-9?
The portal auto-drafts GSTR-9 from your filed GSTR-1 and GSTR-3B, and provides a system-computed summary along with GSTR-2A/2B data for credit tables. To verify and complete it we need your audited or finalised financial statements, sales and purchase registers, input tax credit ledger, details of RCM payments, HSN-wise summaries, and any DRC-03 payments made during the year. Differences between books and returns must be explained and, where needed, paid. Sharing these by early November gives enough time for a clean filing before 31 December. We are constructing our own office building in Tambaram. Can we claim ITC on the materials and contractor bills?
No. Section 17(5)(c) and (d) block credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, which covers apparatus and equipment fixed to earth by foundation or structural support, but expressly excludes land, buildings, telecom towers and pipelines laid outside the factory. Note that the Finance Act 2025 retrospectively substituted the phrase plant or machinery with plant and machinery from 1 July 2017, neutralising the wider reading taken in the Safari Retreats ruling. Why should I reconcile GSTR-2B with my purchase books every month?
Because your input tax credit in GSTR-3B is legally restricted to invoices appearing in GSTR-2B. Under Section 16(2)(aa) and Rule 36(4), credit is available only when the supplier has reported the invoice in their GSTR-1 and it flows into your GSTR-2B. Monthly reconciliation catches suppliers who have not filed, invoices reported with wrong GSTINs, duplicate entries and rate differences, before they become mismatch notices. It also protects working capital, since missed credits sit unclaimed. A disciplined monthly reconciliation, matched invoice by invoice, is the single most effective protection against ITC disputes for businesses in Tambaram.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.

If the cab operator is not a body corporate, charges 5 percent, and your business is a body corporate, the liability shifts to you under reverse charge. Is GST payable on my YouTube AdSense earnings?
AdSense payments come from a Google entity located outside India and are remitted in convertible foreign exchange, so for an Indian creator this revenue generally qualifies as export of services, zero-rated when supplied under an LUT after registration. The income still counts towards your Rs.20 lakh aggregate turnover, so a creator whose combined receipts cross the threshold must register even if the entire revenue is export. Brand sponsorships from Indian companies, by contrast, are domestic supplies taxable at 18 percent. Keep the remittance advices safely, as they establish the forex receipt if you later claim a refund of input tax credit.
Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Composition taxpayers as recipients are excluded from this entry. Confirm the agency's constitution from its PAN, because paying under the wrong mechanism creates trouble for both sides.
Which food items became completely tax-free under GST 2.0?
From 22 September 2025, UHT milk, pre-packaged and labelled paneer and chena, and all Indian breads including roti, chapati, paratha and khakhra attract nil GST. In the pharma space, thirty-three notified lifesaving drugs and medicines for cancer and rare diseases also moved to nil rate. Remember that selling nil-rated goods still has compliance effects: you issue a bill of supply instead of a tax invoice for such items, and input tax credit attributable to nil-rated supplies must be reversed proportionately under Rules 42 and 43. My customer in Mumbai asked me to deliver goods directly to his buyer in Tambaram. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b).
