The petitioner challenged a provisional attachment of its bank account. By the time the matter was heard, one year had elapsed from the date of the order. The Court observed that orders of attachment under Section 83 are self-limiting and remain in force for one year only, after which nothing survives for adjudication. The writ petition was accordingly closed, the attachment having ceased to operate by force of the statute itself.
Practical effect: A Chennai business should diarise the date of any Section 83 attachment — after twelve months the bank must release the account, and a fresh order is required if the department wants to continue.
GSTN Advisory dated 1 November 2025 — simplified registration scheme under Rule 14A · 2025-11-01
GSTN operationalised the optional simplified registration scheme under Rule 14A of the CGST Rules from 1 November 2025. Applicants whose self-assessed output tax liability, across CGST, SGST, IGST and cess, does not exceed Rs 2.5 lakh per month can opt in while filing REG-01 and receive registration within three working days, subject to mandatory Aadhaar authentication of the primary authorised signatory and at least one promoter or partner.
What to do about it: Small Chennai businesses starting out can opt for Rule 14A registration to begin billing within days instead of waiting through full verification.
Notification No. 31/2019-Central Tax dated 28.06.2019 · 2019-06-28
This notification made the CGST (Fourth Amendment) Rules, 2019. It inserted rule 10A, requiring a newly registered person to furnish details of a bank account in the name of the registered person and linked to its PAN, within forty five days of the grant of registration or by the due date of the first return, whichever is earlier. It also inserted rule 88A, prescribing the order in which integrated tax credit must be used before central and State tax credit.
Why this matters: A newly registered Chennai business must upload its bank proof promptly, as failure to comply with rule 10A is a recognised ground for suspension and cancellation of registration.
