The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Officers searched a godown storing PVC pipes and issued detention and penalty orders under Section 129(3), recording fictitious vehicle numbers such as 'UPGODOWN02' in the forms. The High Court quashed the orders, holding that Section 129 applies to goods in transit and cannot be invoked against goods stored at immovable premises. The proceedings were held to be without jurisdiction, and the Commissioner was directed to examine the conduct of the officers concerned.

What to do about it: A detention or penalty order under Section 129 relating to stock lying at your premises rather than in a vehicle is jurisdictionally defective.

Late fee on GSTR-3B waived for the February to April 2020 returns

Notification No. 32/2020-Central Tax · 2020-04-03

The late fee payable under Section 47 for GSTR-3B was waived entirely for the tax periods February, March and April 2020, subject to the return being furnished within the extended dates set out for each turnover slab. Large taxpayers had to file by 24 June 2020, while smaller taxpayers had staggered dates running into June and July 2020. If the return was filed after the specified date the waiver fell away and the ordinary late fee revived from the original due date.

What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts.
