The High Court held that this is a drastic power that can be exercised only by the Commissioner or an officer authorised by him, on reasons to believe formed independently from cogent material, and not on borrowed satisfaction taken from another officer's report. The reasons must be recorded in writing and communicated, the taxpayer must be heard at the earliest opportunity, and the block cannot continue beyond one year.
