RSB Transmissions (India) Ltd v. Union of India — Jharkhand High Court, judgment dated 18 October 2022 · 2022-10-18

The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
What is GSTR-2B and why does my consultant match it before filing?
GSTR-2B is an auto-drafted statement of the input tax credit available to you, generated on the 14th of every month from the GSTR-1 and IFF filings of your suppliers. Input tax credit in GSTR-3B can only be claimed for invoices appearing in GSTR-2B, so matching your purchase register against it before filing is essential. If a supplier has not uploaded an invoice, the credit must be deferred and the supplier followed up. My bank account was debited for a GST challan but the cash ledger shows nothing. What do I do?
This is a payment-communication failure between the bank and the portal, and the prescribed remedy is Form PMT-07, filed under Services, then Payments, then Grievance against Payment. For taxpayers registered in Tamil Nadu, which falls in the category of states with the earlier date, the quarterly GSTR-3B under QRMP is due on the 22nd of the month following the quarter. So the return for April to June is due by 22 July, and so on for each quarter. The quarterly GSTR-1 is due by the 13th of the same month. We are constructing our own office building in Thousand Lights. Can we claim ITC on the materials and contractor bills?
No. Section 17(5)(c) and (d) block credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, which covers apparatus and equipment fixed to earth by foundation or structural support, but expressly excludes land, buildings, telecom towers and pipelines laid outside the factory. The Invoice Furnishing Facility (IFF) is an optional facility for QRMP taxpayers to upload B2B invoices for the first two months of a quarter, by the 13th of the following month, up to Rs.50 lakh of invoice value per month. Invoices uploaded through IFF appear in your buyers' GSTR-2B immediately, so they can claim input tax credit without waiting for your quarterly GSTR-1. My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital. Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one. Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct.
