GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.
Practical effect: If you settled 2017-20 demands under the amnesty, preserve the SPL filings and payment proofs; if you missed it, factor full interest into dispute strategy.
Navbharat Imports - AAR Tamil Nadu, Advance Ruling No. 35/AAR/2021, dated 30 September 2021 · 2021-09-30
The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.
Practical effect: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

Exporters who imported inputs without paying integrated tax and compensation cess under the advance authorisation and export oriented unit exemption notifications were barred by Rule 96(10) from claiming refund of integrated tax paid on exports. The Board clarified that where such exporters subsequently paid the exempted tax and cess along with interest and had the bill of entry reassessed by the customs authorities, the exemption is treated as not having been availed and the refund already taken stands regularised.
What it means for you: Chennai exporters facing recovery of integrated tax refunds under Rule 96(10) can close the issue by paying the import duties with interest and getting the bill of entry reassessed.
