The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

The Andhra Pradesh High Court upheld the constitutional validity of Section 16(4) CGST Act, which bars availment of input tax credit after the prescribed deadline, holding that ITC is a conditional concession and the time limit is neither violative of Articles 14, 19 or 300A nor overridden by the non-obstante acceptance of a belated return with late fee. Parliament subsequently granted relief through Section 16(5), retrospectively extending the deadline for FY 2017-18 to 2020-21 up to 30 November 2021.

GSTN introduced a new RCM Liability and ITC Statement on the portal so that reverse charge tax declared in Table 3.1(d) of GSTR-3B can be matched against the corresponding credit claimed in Table 4A(2) and 4A(3). It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.

What to do about it: Reconcile reverse charge payments with the credit taken every month, since the department can now see an RCM ledger for your GSTIN.

Under the reverse charge entry, when a GTA that has not opted for forward charge provides service to specified recipients, the recipient pays the 5 percent tax. Specified recipients include factories, registered persons, body corporates, partnership firms including AOPs, co-operative societies and casual taxable persons. Your factory therefore pays 5 percent in cash through GSTR-3B, reports it in the reverse charge tables, and claims the same amount as input tax credit since freight is a business expense. Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Vepery trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
I claimed some ITC wrongly last year. What interest and penalty apply if I reverse it now?

Is ITC available on food, catering and canteen expenses for our factory staff?
Section 17(5)(b) blocks credit on food, beverages and outdoor catering, but with two useful exceptions. First, where you use catering as an input for making an outward supply of the same category, such as a caterer subcontracting another caterer, credit is allowed. Second, where providing the facility is obligatory for the employer under any law, credit is allowed; the classic case is a statutory canteen required under the Factories Act for factories employing more than 250 workers. Even then, credit is typically restricted to the cost borne by the employer, not amounts recovered from employees. Why is there GST on an under-construction flat but not on a ready-to-move one?

Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter. How much time do I get to raise an invoice for services?
A tax invoice for services must be issued within thirty days from the date of supply of the service. For banks, insurers, financial institutions and NBFCs, the limit is forty-five days. Where services are supplied continuously, the invoice follows the contract: if the due date of payment is ascertainable, invoice on or before that date; if not, invoice when payment is received; and if payment is linked to completion of an event or milestone, invoice on or before its completion. Consultants and agencies that bill quarterly should check their contracts against these rules, since late invoicing defers nothing legally.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses.
