Circular No. 34/8/2018-GST had stated that services such as meter rent, application fees and shifting of lines supplied by an electricity distribution utility are taxable separately. The High Court struck down paragraph 4(1) of that circular, holding that these services are naturally bundled with the exempt supply of transmission and distribution of electricity and therefore take the character of the principal exempt supply. A circular cannot narrow the scope of an exemption notification.

CBIC clarified that under Rule 88B(3), interest under Section 50(3) arises only where wrongly availed input tax credit has actually been utilised. Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.

Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value.
