40th GST Council Meeting (video conferencing) — 12 June 2020 · 2020-06-12
As COVID relief, the Council reduced late fee for all pending GSTR-3B returns for the tax periods from July 2017 to January 2020. Where there was no tax liability the late fee was reduced to nil, and where there was a tax liability it was capped at Rs 500 per return. The reduced or waived late fee applied only if the returns were furnished between 1 July 2020 and 30 September 2020. Certain clauses of the Finance Act, 2020 were brought into force.
Practical effect: This was the single largest late fee amnesty of the early GST years, and businesses that used it cleared years of backlog for a few hundred rupees per return.
GSTN Advisories dated 11 April 2025 and 16 May 2025 — Table 3.2 of GSTR-3B · 2025-04-11
GSTN first advised that from the April 2025 period, auto-populated values in Table 3.2 of GSTR-3B, covering inter-state supplies to unregistered persons, composition taxpayers and UIN holders, would become non-editable, with corrections routed through GSTR-1A. After taxpayer representations, a 16 May 2025 advisory kept Table 3.2 editable for the time being. The locking was later subsumed in the broader hard-locking of GSTR-3B liability during 2025.
What to do about it: Report place-of-supply details correctly in GSTR-1 itself, since state-wise B2C figures in GSTR-3B are moving beyond manual correction.
Notification No. 02/2023-Central Tax · 2023-03-31
CBIC waived late fee in excess of Rs 500 per return (CGST plus SGST) for composition taxpayers who had not filed GSTR-4 for the quarters from July 2017 to March 2019 or for the financial years 2019-20 to 2021-22, and waived it fully where the return was a nil return. The concession applied to returns filed between 1 April 2023 and 30 June 2023, a window later extended to 31 August 2023.
How we apply it: Composition dealers with old unfiled GSTR-4s could clear the entire backlog for a nominal cost, so pending-return notices from this period should cite this amnesty.
