Notification No. 52/2020-Central Tax · 2020-06-24
For the tax periods July 2017 to January 2020 the late fee on GSTR-3B was capped at Rs 500 per return, being Rs 250 each under the central and State laws, and was waived completely where the return was a nil return. The concession applied only if the pending return was furnished between 1 July 2020 and 30 September 2020. The same notification also continued conditional waivers for the February to July 2020 returns.
What it means for you: This was the first true GST amnesty and it let Chennai businesses clear more than two years of backlog for a nominal fee, setting the template for the later 2021 scheme.
Premier Sales Promotion (P) Ltd v. Union of India — Karnataka High Court, 2023 · 2023-01-16
A company procuring and supplying prepaid vouchers, gift cards and e-vouchers to corporate clients was held liable to GST by the AAR and AAAR. The Karnataka High Court reversed, holding that vouchers are in the nature of pre-deposit instruments or actionable claims — a means of payment for future supplies — and their mere trading is neither a supply of goods nor of services, so no GST is payable on the voucher itself. CBIC later clarified voucher taxation consistently with this position.
What to do about it: Businesses running gift card and reward programmes should tax the underlying redemption supply, not the voucher transaction, and review past assessments in light of this ruling.
Circular No. 200/12/2023-GST, dated 1 August 2023 · 2023-08-01
Giving effect to the 50th GST Council decisions, CBIC clarified that un-fried and uncooked snack pellets manufactured by extrusion are classifiable under tariff item 1905 90 30 and attract five per cent with effect from 27 July 2023, and that fish soluble paste moved from eighteen to five per cent from the same date. Imitation zari thread or yarn made from metallised polyester or plastic film was placed at five per cent, and past periods were regularised on an as-is basis.
What to do about it: Snack and zari manufacturers in and around Chennai got both a lower rate and protection for past periods, so old demands on these items should be contested with this circular.
