The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. Swiggy's parent, Bundl Technologies, paid large sums at odd hours during a DGGI investigation into alleged wrongful ITC and contended the payments were made under threat of arrest. The Karnataka High Court held that collection of tax during investigation without assessment or self-ascertainment offends Article 265, found the payments involuntary in the circumstances, and directed the department to consider refund; a Division Bench affirmed the taxpayer-protective reasoning on threat and coercion.
What it means for you: Document the timeline and circumstances of any payment made during an investigation — midnight or pre-adjudication payments can be reclaimed as involuntary deposits.
Circular No. 216/10/2024-GST · 2024-06-26
This circular amends and supplements the earlier warranty circular. It extends the treatment from replacement of parts to replacement of goods or their parts, so that a full product replacement under warranty is covered on the same basis, with no GST and no credit reversal. It also addresses the position where a distributor replaces goods out of its own stock and is later replenished by the manufacturer, and the treatment of extended warranty sold separately after the original supply.
What it means for you: Chennai dealers who swap out an entire defective product under warranty are now expressly covered, so no output tax or credit reversal is required.
