It asked whether it needed registration and whether the rent was exempt because the tenant was the government. The Authority held that renting of commercial property by the Board to a government or a business entity is not an exempt supply, so GST was payable on the rent collected.

Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.

Two rules operate. For admission to an event, including tickets to exhibitions or conferences, the place of supply is where the event is held. For organising an event or providing training, the place of supply is the registered recipient's location when the client is registered; if the client is unregistered, it shifts to the venue where the event or training is actually performed. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
I declare income under Section 44ADA. Does that mean I am exempt from GST?
No, this is a common myth. Section 44ADA is a presumptive taxation scheme under the Income Tax Act that lets professionals declare fifty percent of gross receipts as income; it has nothing to do with GST. GST liability depends solely on aggregate turnover crossing the registration threshold and the nature of your supplies. In fact, the two departments now cross-match data, so gross receipts reported in your ITR and Form 26AS that exceed the GST turnover you declared are a known trigger for notices. Treat the two laws as parallel obligations, each with its own limits and filings.
What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier.
