22nd GST Council Meeting, New Delhi — 6 October 2017 (PIB Release ID 1505133) · 2017-10-06
The Council raised the composition scheme threshold from Rs 75 lakh to Rs 1 crore of annual aggregate turnover, and from Rs 50 lakh to Rs 75 lakh for Special Category States other than Jammu and Kashmir and Uttarakhand, which were given Rs 1 crore. Both migrated and new taxpayers could opt in under the higher threshold up to 31 March 2018, with the option becoming operational from the first day of the month following the month in which it was exercised.
Practical effect: This brought a large part of Chennai's small trading and restaurant sector within reach of quarterly composition filing instead of monthly returns.
Anil Kumar Agrawal — AAR Karnataka, Advance Ruling No. KAR ADRG 30/2020, dated 4 May 2020 · 2020-05-04
The Karnataka AAR examined which income streams of an individual count towards aggregate turnover for GST registration. It held that salary received as an executive, full-time director is outside the ambit of GST and not includable in aggregate turnover. In contrast, remuneration of a non-executive director is a taxable service, and such amounts, along with partner's salary from a firm, interest income and rental income — including residential rent that is itself exempt — must be counted when testing the registration threshold.
Why this matters: Individuals with mixed income should compute the GST registration threshold carefully, excluding employee salary but including non-executive director fees and rentals.
Notification No. 34/2023-Central Tax · 2023-07-31
With effect from 1 October 2023, persons making only intra-State supplies of goods through e-commerce operators were exempted from mandatory GST registration if their aggregate turnover stays within the threshold limit. Conditions include obtaining an enrolment number on the portal using PAN, operating in a single State or Union Territory, declaring the enrolment number to the platform, and not making inter-State supplies. Earlier, any online sale of goods forced immediate registration.
