The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.

How does ITC reversal work for capital goods used for both taxable and exempt supplies?
Rule 43 treats every commonly used capital good as having a useful life of five years, so its total credit is spread over sixty months for reversal purposes. Each month, one-sixtieth of the credit on all common capital goods is attributed to the period, and the exempt proportion, computed on the exempt-to-total turnover ratio, is reversed in GSTR-3B with applicable interest treatment. Capital goods used exclusively for taxable supplies need no reversal, while those used exclusively for exempt supplies get no credit at all. Keep a capital goods register with commissioning dates, because the sixty-month clock and any change in use must be tracked asset-wise.
I paid my supplier only part of the invoice within 180 days. How much ITC do I reverse?
The reversal is proportionate. If you paid sixty percent of the invoice value including tax within 180 days, you reverse only the ITC attributable to the unpaid forty percent, reporting it in Table 4(B)(2) of the GSTR-3B for the tax period immediately following the expiry of the 180 days. Amounts settled through book adjustments, such as netting off mutual dues or debit notes for quality deductions reducing the payable, have been accepted as payment in advance rulings, so a properly documented ledger adjustment protects the credit. Retention money held under contract terms is the most common trigger we see in Chetpet construction and job-work businesses.
What are the conditions under Section 16 I must satisfy before claiming any input tax credit?

Where is the place of supply for services connected to a building or land?
Services directly relating to immovable property, including those of architects, interior decorators, engineers, surveyors, construction and works contract services, renting, and accommodation in hotels, are supplied where the property is located, under Section 12(3). The recipient's location and registration are irrelevant. So a Chetpet architect designing a factory in Coimbatore charges CGST plus SGST of Tamil Nadu, but for a project in Kochi the place of supply is Kerala and IGST applies. You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible.
