A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

What it means for you: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Acting on a Group of Ministers report, the Council cut rates on COVID relief goods until 30 September 2021. Tocilizumab and Amphotericin B moved to nil, while Remdesivir and anti-coagulants such as heparin were reduced to 5 per cent. Medical grade oxygen, oxygen concentrators, ventilators, BiPAP machines, COVID testing kits and specified diagnostic kits all moved from 12 to 5 per cent. Pulse oximeters, hand sanitiser, temperature check equipment and crematorium furnaces moved to 5 per cent, and ambulances from 28 to 12 per cent.

What it means for you: These were temporary rates with a hard expiry, so suppliers must be able to show that concessional invoices fall inside the notified relief period.

I paid a demand through DRC-03 but the portal still shows it outstanding. What is Form DRC-03A?
This happens because a DRC-03 payment does not automatically knock off a demand created in the electronic liability register through DRC-07. Form DRC-03A, introduced through Notification 12/2024 and Rule 142(2B), lets you link an earlier DRC-03 payment made under the cause voluntary or others to a specific demand order. File it under My Applications, select the DRC-03 ARN and the demand order number, and the system adjusts the liability register accordingly. What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. Which GST orders can I appeal against?

What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
What is the difference between the electronic cash ledger and the electronic credit ledger?
The electronic cash ledger reflects actual money you have deposited through challans, plus TDS and TCS credits you have accepted; it can pay tax, interest, penalty, late fee and any other amount. The electronic credit ledger reflects input tax credit claimed through your returns, and it can be used only for paying output tax, never for interest, penalty or late fee. What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
