CBIC clarified that granting a loan or advance between related persons, including by an overseas affiliate to its Indian affiliate, is a supply of service, but the consideration for that service is represented only by interest or discount, which is exempt. Where no processing fee, service fee or administrative charge is levied, there is no taxable consideration, and no notional interest can be imputed merely because the parties are related. GST applies only to fees actually charged.
Practical effect: Group companies extending interest-free funding to each other owe no GST, but any documentation or processing fee charged is taxable and must be invoiced.

Under Section 70 of the Karnataka VAT Act, the Supreme Court held that the dealer claiming input tax credit bears the burden of proving the transaction actually took place — producing invoices and payment by cheque is not enough. The dealer should establish the seller's particulars, actual movement of goods, freight and delivery details.
