CBIC listed six situations that must not attract detention proceedings where both an invoice and an e-way bill accompany the goods: a spelling mistake in the consignor or consignee name where the GSTIN is correct, a wrong PIN code where the address is correct, an error in one or two digits of the document number, an error in the fourth or sixth digit of the HSN where the rate is right, and an error in the vehicle number. Penalty is only Rs 500 each under CGST and SGST in FORM GST DRC-07.
Why this matters: A typing slip in an e-way bill should cost Rs 1,000, not a section 129 demand of tax and penalty, and this circular is the first thing to quote in reply.
Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19
The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.
What it means for you: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.
GSTN Advisory, November 2024 — Form GST DRC-03A functionality on the portal (Rule 142(2B) and Notification No. 12/2024-Central Tax, dated 10 July 2024) · 2024-11
Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.
Practical effect: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.
