Council decides to introduce electronic invoicing for B2B supplies in phases

35th GST Council Meeting, New Delhi — 21 June 2019 · 2019-06-21

At the first meeting chaired by Finance Minister Nirmala Sitharaman, the Council decided to introduce an electronic invoicing system in a phase-wise manner for business-to-business transactions. The press release recorded that e-invoicing would help taxpayers with backward integration and automation of tax-relevant processes and would help authorities combat evasion, with Phase 1 proposed to be voluntary and rolled out from January 2020. This decision is the origin of the Invoice Registration Portal, the IRN and the QR code now mandatory for most mid-sized and large businesses.

After representations the implementation was deferred by three months. The idea returned later as a thirty day reporting limit applying to taxpayers with turnover of ten crore rupees and above.

It clarified that service by cloud kitchens and central kitchens is restaurant service attracting 5 per cent without input tax credit, while ice cream parlours that sell already manufactured ice cream without any element of cooking supply goods and attract the applicable goods rate with credit. It also clarified the treatment of coaching services supplied under a government scholarship scheme, overloading charges recovered at toll plazas, and services in relation to admission to amusement parks.

What is GSTR-2B and why does my consultant match it before filing?
GSTR-2B is an auto-drafted statement of the input tax credit available to you, generated on the 14th of every month from the GSTR-1 and IFF filings of your suppliers. Input tax credit in GSTR-3B can only be claimed for invoices appearing in GSTR-2B, so matching your purchase register against it before filing is essential. If a supplier has not uploaded an invoice, the credit must be deferred and the supplier followed up. This monthly reconciliation is included in our return filing service for businesses in Guindy.
We are constructing our own office building in Guindy. Can we claim ITC on the materials and contractor bills?

Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost. Companies in Guindy should route CSR procurement through a separate expense code so their monthly reconciliation automatically excludes these invoices from the ITC claim.

Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. Event management services attract 18 percent with full input tax credit.
