Union of India v. Bharti Airtel Ltd — Supreme Court, 2021 · 2021-10-28
Bharti Airtel sought to rectify its GSTR-3B for July-September 2017 to claim refund of about Rs 923 crore excess cash paid, blaming the non-operational GSTR-2A at the time. The Supreme Court set aside the Delhi High Court order permitting rectification, holding that returns can only be corrected in the period in which errors are noticed, as the law then stood, and that taxpayers must self-assess from their own books, not the portal.
Why this matters: File GSTR-3B accurately the first time — correct discovered errors in the current period per the prescribed mechanism rather than expecting retrospective revision of old returns.
GSTN Advisory dated 25 April 2025 — Phase-III of HSN reporting in Table 12 of GSTR-1/1A · 2025-04-25
GSTN implemented Phase-III of mandatory HSN reporting in Table 12 of GSTR-1 and GSTR-1A from the May 2025 return period, after the change was deferred from earlier periods. Manual keying of HSN codes is replaced by selection from a dropdown, Table 12 is split into separate B2B and B2C tabs, and new value validations compare the taxable values reported across tables. Table 13, the summary of documents issued, also became mandatory. Taxpayers up to Rs 5 crore turnover report 4-digit codes; larger taxpayers report 6-digit codes.
Practical effect: Update your billing software's HSN masters so every item carries a valid 4 or 6 digit code that matches the portal dropdown.
Notification No. 2/2017-Central Tax (Rate), dated 28 June 2017 (G.S.R. 674(E)) · 2017-06-28
This companion notification exempted intra-State supplies of listed goods from central tax altogether, covering fresh vegetables and fruit, unbranded cereals and pulses, milk, curd, salt, live animals, human blood, printed books, judicial stamp paper and many agricultural items. Suppliers dealing only in these goods make exempt supplies, cannot claim input tax credit on related purchases, and must reverse credit under Rule 42 where inputs are common. It was superseded with effect from 22 September 2025.
Practical effect: A Chennai trader dealing in exempt goods should not charge GST on them, but must equally accept that input credit on the related expenses is not available.
