Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.
What to do about it: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.

This notification made the Central Goods and Services Tax Rules, 2017. In its original form it carried the chapters on preliminary definitions, composition levy and registration, together with the associated forms in the REG and CMP series. Every later amendment to the GST rules, from e-way bills to input tax credit restrictions to annual return formats, is technically an amendment to the rules notified here.

A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.
Why this matters: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.
