Circular No. 76/50/2018-GST dated 31 December 2018 · 2018-12-31
This circular answered a set of unrelated questions. The most important is that the penalty under section 73(11) does not apply where self-assessed tax shown in the return is paid late; only interest under section 50 and, where warranted, general penalty under section 125 arise. It also dealt with the rate applicable to notes issued under section 142(2) and who is the owner of goods in transit. A corrigendum of 7 March 2019 clarified that tax collected at source under the Income-tax Act is not included in the taxable value.
Why this matters: If a demand adds a heavy penalty simply because GSTR-3B tax was paid late, this circular is the answer.
Notification No. 28/2023-Central Tax · 2023-07-31
This notification appointed 1 October 2023 as the date for most GST amendments of the Finance Act 2023. The most consequential change bars taxpayers from filing GSTR-1, GSTR-3B, GSTR-9 and GSTR-8 after three years from their due date. The GST portal began actually blocking such time-barred returns from the July 2025 tax period, permanently freezing any unfiled compliance older than three years along with the credit flowing from it.
Practical effect: Any return more than three years past its due date can no longer be filed at all, so clear historic backlogs immediately rather than assuming they can be regularised later.
39th GST Council Meeting, New Delhi — 14 March 2020 · 2020-03-14
Following widespread demands computing interest on the gross tax liability of a late GSTR-3B, ignoring the credit balance available, the Council recommended that interest under Section 50 be charged only on the net cash tax liability, with retrospective effect from 1 July 2017. This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.
What to do about it: If you have received an interest demand computed on gross output tax for a late return, the net cash liability principle from this meeting is usually a complete answer.
