Rule 37A requires a buyer to reverse input tax credit where the supplier reported the invoice in GSTR-1 but did not file the GSTR-3B for that tax period by 30 September following the end of the financial year. The reversal must be made in the GSTR-3B filed on or before 30 November. GSTN made supplier-wise details of such invoices available on the portal and advised taxpayers to complete the reversal for FY 2022-23 by 30 November 2023. The credit can be reclaimed once the supplier files the pending return.

What to do about it: Run a supplier compliance check every October, because credit from a defaulting supplier must be reversed by 30 November or carries interest.

The Court examined whether canned or branded software sold on floppies and discs could be taxed as goods under sales tax law. It held that the term goods covers all types of movable property, tangible or intangible, provided the item can be abstracted, transmitted, transferred, delivered, stored and possessed. Branded software satisfies that test and is goods, even though the intellectual content is intangible. Customised software developed for a single customer stands on a different footing.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Since 1 January 2019, security services by way of supply of security personnel provided by any person other than a body corporate to a registered person fall under reverse charge, so your business pays the 18 percent directly and claims credit. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. How do I handle GST when expired medicines are returned to the distributor?
CBIC Circular 72/46/2018 gives two routes for time-expired drugs. The return can be treated as a fresh supply by the person returning them, with a tax invoice if that person is registered, or the original supplier can issue a credit note under Section 34; the tax adjustment on a credit note is available only if it is reported within the statutory window, now 30 November following the financial year of supply. Where the manufacturer ultimately destroys the expired stock, input tax credit relating to the destroyed goods must be reversed under Section 17(5)(h). My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
I claimed some ITC wrongly last year. What interest and penalty apply if I reverse it now?
Under Section 50(3) as amended, interest at 18 percent per annum applies where wrongly availed credit has also been utilised, calculated from the date of utilisation until reversal; credit that was availed but never utilised, because your ledger balance never fell below the wrong amount, attracts no interest. Voluntary reversal is done through GSTR-3B or by payment in DRC-03, and paying before any show cause notice generally avoids or minimises penalty. How is GST charged on hotel room tariffs after the rate changes?
