Dealing with Section 19(11) of the Tamil Nadu VAT Act, the Supreme Court held that input tax credit is a concession created by statute and not an absolute or constitutional right. The legislature may impose conditions, including a time limit for claiming it, and such a limit is mandatory rather than directory. A dealer who claims credit after the prescribed period loses it. This reasoning is routinely applied to Section 16(4) of the CGST Act.
What to do about it: Chennai businesses must claim input tax credit within the statutory deadline, since courts have consistently refused relief for late claims.

Where the liability declared in GSTR-1 for a tax period exceeds the liability paid through GSTR-3B beyond the prescribed limit, the system issues an intimation in Form GST DRC-01B. The taxpayer must either pay the difference with interest through Form DRC-03 or file a reply in Part B of DRC-01B explaining the reasons, within seven days. If no action is taken, the next GSTR-1 cannot be filed.

The Board clarified two unrelated points. A no claim bonus allowed by an insurer is a permissible discount under Section 15(3)(a) and may be deducted from the value of the insurance service, provided it is shown in the invoice. Separately, where an entity is exempt from the requirement to issue e-invoices, that exemption attaches to the entity as a whole and covers all its supplies, including supplies unrelated to the activity that gave rise to the exemption.
How we apply it: An exempt category business such as a bank, insurer or goods transport agency in Chennai need not issue e-invoices for any of its supplies, not merely its core activity.
