Maharashtra, Assam and Bihar had pressed for 1 April 2017, Assam adding that changing the tax regime in the middle of a financial year was undesirable, but the Chairperson observed that the legal and rate work would spill into March 2017 and that an April deadline had become a major challenge. Tamil Nadu and Karnataka supported 1 July 2017 as the more practical date.

Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.

For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. How will I be informed of the GST audit findings?

However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Larger cars, SUVs above these specifications, attract the 40 percent rate, but with the compensation cess gone, the overall burden on most of them is still lower than before. Motorcycles up to 350cc are at 18 percent, while those above 350cc attract 40 percent. Electric vehicles continue at a concessional 5 percent. How do I decide whether to charge CGST plus SGST or IGST on an invoice?
Compare two data points: the location of the supplier and the place of supply determined under the IGST Act. If both fall in the same state, the supply is intra-state and you charge CGST plus SGST; if they fall in different states, it is inter-state and you charge IGST. The buyer's billing address alone is not the test; the place of supply rules for the specific goods or service govern. Common traps include hotel stays, property-linked services and bill-to ship-to chains, where the place of supply departs from the customer's address.
