Notification No. 31/2021-Central Tax · 2021-07-30

Registered persons whose aggregate turnover in the financial year 2020-21 was up to Rs 2 crore were exempted from furnishing the annual return in Form GSTR-9. This continued the exemption already granted for 2017-18 through 2019-20 and was renewed again in later years. The exemption is unconditional and does not require any intimation to the department, although a taxpayer who wishes to file voluntarily, typically to correct earlier errors, remains free to do so.

Practical effect: Most Chennai small businesses were again outside the annual return net for 2020-21, though voluntary filing can be worthwhile where the year's returns need correction.

Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.

What to do about it: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.

What is compounding of offences under GST and how much does it cost?

Can a GST officer arrest a businessman, and what safeguards exist?
Yes, but only within defined limits. Under Section 69, the Commissioner must record reasons to believe that a person has committed one of the serious specified offences, chiefly fake invoicing and evasion beyond the prosecution thresholds, before authorising arrest. For cognizable, non-bailable cases, the person must be produced before a Magistrate within twenty-four hours; for bailable offences, the Deputy or Assistant Commissioner can grant bail. Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. Crucially, adjudication notices such as ASMT-10, DRC-01A and DRC-01 appear under a separate tab called View Additional Notices and Orders, which many taxpayers never open. Also verify that the email and mobile number on your registration are current, since the portal sends alerts there. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items.
