44th GST Council Meeting (video conferencing) — 12 June 2021 · 2021-06-12

Acting on a Group of Ministers report, the Council cut rates on COVID relief goods until 30 September 2021. Tocilizumab and Amphotericin B moved to nil, while Remdesivir and anti-coagulants such as heparin were reduced to 5 per cent. Medical grade oxygen, oxygen concentrators, ventilators, BiPAP machines, COVID testing kits and specified diagnostic kits all moved from 12 to 5 per cent. Pulse oximeters, hand sanitiser, temperature check equipment and crematorium furnaces moved to 5 per cent, and ambulances from 28 to 12 per cent.

Why this matters: These were temporary rates with a hard expiry, so suppliers must be able to show that concessional invoices fall inside the notified relief period.

Portal Advisory

Portal allowed a limited re-filing of GSTR-3B where figures were wrongly carried in

GSTN Advisory, April 2024 — reset and re-filing of Form GSTR-3B for certain identified taxpayers · 2024-04

GSTN found that in a small number of cases credit or liability figures had been wrongly auto-populated into GSTR-3B. The affected returns were reset and made available for filing afresh. Only the taxpayers identified by the system saw the option on their dashboard and they were given a short window to verify the figures and file again. No general facility to revise a filed GSTR-3B was created.

Practical effect: A filed GSTR-3B still cannot be revised as a rule, so verify the auto-populated figures carefully before you submit the return.

Concessional rate withdrawn for works contracts to government authorities and entities

Notification No. 15/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18

This notification removed the words governmental authority and government entity from the concessional works contract entries in the services rate notification. With effect from 1 January 2022, works contract services supplied to a governmental authority or a government entity ceased to enjoy the 12 per cent rate and moved to 18 per cent with input tax credit. Only supplies made directly to the Central Government, a State Government, a Union territory or a local authority continued at the concessional rate at that stage.

How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. How is interest calculated if I pay GST late?
Interest is charged at 18 percent per annum under Section 50 of the CGST Act, calculated day-wise from the due date until the date of payment. Following the amendment to Section 50, interest on delayed GSTR-3B filing applies only on the portion of tax paid through the electronic cash ledger, not on the amount settled using input tax credit. My supplier filed GSTR-1 but never filed GSTR-3B. Does that affect my credit?
Yes, through Rule 37A. If your supplier reports the invoice in GSTR-1, the credit flows into your GSTR-2B and you may claim it, but if that supplier has not filed the GSTR-3B for the same period by 30 September following the end of the financial year, you must reverse the credit in a return filed on or before 30 November. Reversal done within this window carries no interest; delay beyond it attracts interest at 18 percent. The credit can be re-availed once the supplier eventually files GSTR-3B. A supplier filing-status check is therefore now part of any serious reconciliation for businesses in Madhavaram.
