The Board clarified two unrelated points. A no claim bonus allowed by an insurer is a permissible discount under Section 15(3)(a) and may be deducted from the value of the insurance service, provided it is shown in the invoice. Separately, where an entity is exempt from the requirement to issue e-invoices, that exemption attaches to the entity as a whole and covers all its supplies, including supplies unrelated to the activity that gave rise to the exemption.

The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.
Practical effect: Compensation cess on items like aerated drinks, coal and motor vehicles continued to apply to fund loan repayment, so businesses dealing in cess goods had to keep charging it.

The Supreme Court held that penalty is not to be imposed merely because it is lawful to do so. The authority must exercise discretion judicially and consider all relevant circumstances. Penalty should not be imposed where the breach is technical or venial, or where the failure arose from a bona fide belief that the taxpayer was not liable to act as demanded. This remains the leading authority on discretionary penalties.
