Sponsorship services supplied by any person to a body corporate or partnership firm located in the taxable territory were placed under reverse charge, so the sponsor paying for naming rights, event branding or team sponsorship had to discharge the tax. The entry has since been narrowed: on the recommendation of the GST Council at its 55th meeting, sponsorship services supplied by body corporates were moved to forward charge, leaving reverse charge to apply mainly where the sponsorship provider is not a body corporate.

CBIC clarified that where a manufacturer replaces parts or provides repair services free of cost during the warranty period, no further GST is payable because the value of the warranty was already included in the price of the original supply on which tax was paid. Consequently the manufacturer need not reverse input tax credit on such replacement parts. Where a distributor replaces parts from his own stock and is reimbursed through a credit note, the position was explained separately.
What to do about it: Manufacturers and dealers should not pay GST again on warranty replacements, and should resist ITC reversal demands raised on free-of-cost warranty issues.

The electronic credit ledger was blocked by a State Tax Officer. The High Court quashed the blocking, holding that Rule 86A permits only the Commissioner, or an officer authorised by him who is not below the rank of Assistant Commissioner, to exercise the power. A general delegation notification issued under the State GST Act could not override that express requirement written into the rule, so the order of the lower-ranked officer was without jurisdiction.
Why this matters: When your ledger is blocked, check the designation of the officer who signed the order — anything below Assistant Commissioner is open to challenge.
