Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. When can I issue a GST credit note against my sales invoice?
Section 34 permits a credit note where the taxable value or tax charged in the invoice exceeds what is actually payable, where the goods are returned by the recipient, or where the goods or services are found deficient. My supplier is delivering one order in several instalments. When can I claim the ITC?
Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Amounts settled through book adjustments, such as netting off mutual dues or debit notes for quality deductions reducing the payable, have been accepted as payment in advance rulings, so a properly documented ledger adjustment protects the credit.
