For appeals to the GST Appellate Tribunal, the pre-deposit was reduced from twenty per cent to ten per cent of the disputed tax, subject to a ceiling of Rs 20 crore each of CGST and SGST, in addition to the amount already deposited at the first appellate stage.

Deciding a batch of petitions, the High Court held that Rule 86A permits an officer to disallow debit only of the input tax credit actually available in the electronic credit ledger on the date of the order. Creating an artificial negative balance so that credit accruing later is also blocked is impermissible. The Court emphasised that Rule 86A is a temporary protective measure and not a recovery tool, and therefore must be construed strictly.
What to do about it: Negative blocking of the credit ledger is now squarely disapproved — raise it immediately if your ledger is blocked for more than the balance you held.
CBIC Instruction No. 01/2025-GST · 2025-01-13
Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.
Practical effect: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.
