The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
Practical effect: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.
Circular No. 49/23/2018-GST dated 21 June 2018 · 2018-06-21
This circular modified the detention procedure. The expression three working days in the earlier circular was replaced by three days, and the release wording in FORM GST MOV-05 was corrected. Most importantly it reiterated rule 138C(2): once physical verification of goods in transit has been carried out at one place, no further physical verification of the same conveyance may be done anywhere in India unless specific information relating to tax evasion is made available subsequently.
Why this matters: A truck already verified once should not be stopped and unloaded again on the same journey, and the earlier verification report is your defence.
Bundl Technologies (P) Ltd v. Union of India — Karnataka High Court, 2021 (affirmed by Division Bench, 2022) · 2021-09-14
Swiggy's parent, Bundl Technologies, paid large sums at odd hours during a DGGI investigation into alleged wrongful ITC and contended the payments were made under threat of arrest. The Karnataka High Court held that collection of tax during investigation without assessment or self-ascertainment offends Article 265, found the payments involuntary in the circumstances, and directed the department to consider refund; a Division Bench affirmed the taxpayer-protective reasoning on threat and coercion.
