A five-judge Bench held that circulars issued by the Board cannot prevail over the statute, and are not binding on courts. Where the Supreme Court or a High Court has declared the law on an issue, that declaration prevails and any contrary circular ceases to have effect. Circulars remain an aid to administration and can bind officers, but they cannot enlarge or restrict what the legislature has enacted.
What it means for you: Chennai businesses should treat CBIC circulars as useful administrative guidance, but should not rely on one that conflicts with the plain words of the GST Act.
Notification No. 9/2025-Central Tax (Rate) · 2025-09-17
Implementing the 56th GST Council's rate restructuring, this notification superseded Notification 1/2017-Central Tax (Rate) and prescribed the new goods rate schedule effective 22 September 2025. The 12 and 28 per cent slabs were largely abolished: most daily-use and 12 per cent goods moved to 5 per cent, most 28 per cent goods including consumer durables moved to 18 per cent, and a 40 per cent rate was reserved for a narrow list of sin and luxury goods, with compensation cess subsumed.
Practical effect: Reprice products, update billing software rate masters and review transition stock credits from 22 September 2025, since almost every trader's rate schedule changed under GST 2.0.
Circular No. 206/18/2023-GST · 2023-10-31
The Board answered a set of service taxability questions arising from the 52nd GST Council meeting. Among them, it confirmed that District Mineral Foundation Trusts set up by State Governments qualify as Governmental Authorities and are therefore eligible for the exemptions available to such authorities. Other classification and exemption questions on specified services were also settled, so that field formations across States adopt a uniform view rather than issuing conflicting demands.
What to do about it: Contractors in Tamil Nadu working for statutory trusts and authorities should verify the exemption position against this circular before quoting a GST-inclusive price.
