I received a GSTR-3A notice for not filing my GST returns. What should I do?
GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. How often should I get a GST health check done for my business?
At minimum once a year, ideally between September and December, because that window still allows you to correct the previous financial year through the November return-amendment deadline and finalise a clean GSTR-9 by its 31 December due date. Businesses with turnover above Rs.5 crore, multiple registrations or heavy ITC should review quarterly, since e-invoice obligations and larger credit volumes raise the stakes. A health check is also wise before events such as applying for a large refund, receiving an ADT-01 audit intimation, or a business sale, when past compliance suddenly gets examined closely. How is interest calculated on a GST demand or late payment?
Interest runs at 18 percent per annum under Section 50 on tax paid after the due date, computed day-wise from the day following the due date until payment. Following amendments, interest on delayed GSTR-3B liability applies on the portion paid through the electronic cash ledger, and interest on wrongly availed ITC arises where the credit has been both availed and utilised. Interest is payable even where no penalty applies, and it cannot be waived by the officer. Because interest compounds silently over long disputes, paying the admitted tax early through DRC-03, even while contesting the rest, often saves a substantial amount.
What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Notably, several products that earlier suffered 28 percent moved down to 18 percent from 22 September 2025: air conditioners, televisions of all sizes, dishwashers, cement, small cars and motorcycles up to 350cc, and most auto parts. Apparel and footwear priced above Rs.2,500 per piece also fall at 18 percent. Most professional, business support and repair services billed by professional firms continue at 18 percent with full input tax credit.
My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital. Repeated delays lead buyers to withhold the GST portion of payments or move to more compliant vendors. Timely GSTR-1 filing is therefore a commercial necessity, not just a legal one. What is the difference between ISD and cross-charge, and when is each used?

What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
If I open a bulk bag and sell rice loose by weight, is that sale taxable?
No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms. When a retailer opens bulk stock and weighs out loose quantities against each customer's order, the supply is not of a pre-packaged commodity, so it remains exempt. What you cannot do is sell an intact labelled retail pack and bill it as loose. Keep purchase records showing bulk procurement and maintain the loose counter separately from the packed shelf, because officers test this distinction during inspections of grocery businesses. Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value.
