Quote the CPIN, bank name and debit details; the system takes up the discrepancy with the bank, and the amount either credits your ledger once the bank confirms, or is re-credited to your account if the transaction failed. Do not pay twice immediately; most cases resolve within a day or two. If a return due date is pressing, generate a fresh challan and later seek refund of the duplicate. What are the conditions under Section 16 I must satisfy before claiming any input tax credit?
Section 16(2) prescribes cumulative conditions: you must hold a valid tax invoice or debit note, you must have actually received the goods or services, the supplier must have paid the tax to the government, and you must have filed your GSTR-3B. Added to these, the invoice must appear in your GSTR-2B and must not be restricted there. In practice this means a genuine purchase can still fail the test if your supplier defaults. What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Triplicane manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. How is interest calculated on a GST demand or late payment?
Interest runs at 18 percent per annum under Section 50 on tax paid after the due date, computed day-wise from the day following the due date until payment. Following amendments, interest on delayed GSTR-3B liability applies on the portion paid through the electronic cash ledger, and interest on wrongly availed ITC arises where the credit has been both availed and utilised. Interest is payable even where no penalty applies, and it cannot be waived by the officer. Because interest compounds silently over long disputes, paying the admitted tax early through DRC-03, even while contesting the rest, often saves a substantial amount.
Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
My customer says he cannot claim ITC because of my late filing. Is that correct?
Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings.
