Finalising the formats behind the principles approved in May, the Council approved optional quarterly return filing with monthly payment of tax for small taxpayers with turnover below Rs 5 crore, noting that 93 per cent of taxpayers fall below that figure. Two simplified formats were designed: Sahaj for small traders making only B2C supplies and Sugam for those making both B2B and B2C supplies. Both required less information than the regular return.

Practical effect: Sahaj and Sugam were never implemented as designed, but the Rs 5 crore turnover line and the quarterly-return-with-monthly-payment model survive in today's QRMP scheme.

Standard procedure for processing a voluntary cancellation application

Circular No. 69/43/2018-GST dated 26 October 2018 · 2018-10-26

This circular set out how officers must handle an application for cancellation of registration in FORM GST REG-16. The officer should verify the application and, if satisfied, pass the cancellation order in FORM GST REG-19 within thirty days. Pending returns are to be filed and any liability discharged, and the taxpayer must file the final return in FORM GSTR-10 within three months of the cancellation order. Cancellation cannot be refused merely because dues are outstanding.

What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. How are B2B and B2C invoices reported differently in GST returns?

GSTR-2B is a static statement generated on the 14th of each month, capturing supplier filings between cut-off dates, and it never changes afterwards. The law ties your ITC eligibility to GSTR-2B, and GSTR-3B auto-populates from it, so 2B is the statement to reconcile against for monthly claims. GSTR-2A remains useful for tracing when an invoice was actually uploaded, which helps in replying to departmental queries about earlier periods.
What is the 180-day payment rule for input tax credit?
Under the second proviso to Section 16(2) read with Rule 37, if you do not pay your supplier the invoice value including tax within 180 days from the invoice date, you must reverse the proportionate ITC in GSTR-3B, along with interest at 18 percent per annum from the date of availment. The credit can be re-availed, without any time limit, once payment is actually made. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
