Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
What to do about it: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.

The Supreme Court held that where a special taxing statute provides a complete code with its own limitation scheme, the general provisions of the Limitation Act permitting condonation of delay do not apply. Delay in filing a reference or appeal beyond the period prescribed by the special statute cannot be condoned. The scheme, language and object of the special Act determine whether the Limitation Act is impliedly excluded.
Practical effect: Chennai businesses must treat GST appeal and revision deadlines as absolute, since general limitation relief is not available.
